Beating victim Bryan Stow doesn’t have to pay ex-Dodgers owner Frank McCourt $400,000 in legal fees

first_imgLos Angeles Dodgers LLC will have to pay about $14.1 million of the final judgment, Girardi said. But the panel exonerated McCourt of any culpability in the attack that left Stow, now 45, with permanent brain damage.Stow’s attorneys had asked Chavez to stage a second phase of trial, without a jury, to decide whether McCourt and Los Angeles Dodgers LLC were one and the same, arguing the issue should have been resolved before the trial so the original panel would not have been confused during deliberations. The Stow attorneys had maintained that without the finding that McCourt was the “alter ego” of Los Angeles Dodgers LLC, McCourt’s lawyers could have asked for a recovery of many of his trial-related costs, including the hefty prices charged by his expert witnesses. Girardi said McCourt’s expenses did not involve attorneys’ fees but that they still could have totaled about $400,000.McCourt’s attorneys countered that Stow’s lawyers made the decision to try a “meritless claim” against their client and forced him to incur costs to defend himself. McCourt’s lawyers also stated that their client’s insurance will cover all of the judgment apportioned against Los Angeles Dodgers LLC. Newsroom GuidelinesNews TipsContact UsReport an Error Today’s agreement means there will not be a trial on the alter ego issue. The current ownership of the Dodgers was not targeted in the lawsuit and has no liability in the case.Stow, a former paramedic from Capitola, was punched from behind by Louie Sanchez after the 2011 home opener between the Dodgers and their longtime rivals. Sanchez and fellow Rialto resident Marvin Norwood then kicked Stow, a father of two, after he fell to the ground.Stow’s attorneys maintained security was insufficient and that no officers or guards were present in parking lot 2 when Stow was attacked. They said Sanchez and Norwood should have been ejected from Dodger Stadium hours earlier for unruly behavior and that more uniformed security at the stadium could have deterred their misconduct. But McCourt’s attorneys said the team spent more money on opening day security in 2011 than in previous years and that the attack on Stow happened so fast, security personnel would have had to have been right there as it developed in order to prevent it.Sanchez, 32, and Norwood, 34, pleaded guilty in January to carrying out the attack on Stow and were sentenced to eight- and four-year terms, respectively. They are also both facing a federal weapons charge that could land them in a federal lockup for up to 10 years.center_img Attorneys for Bryan Stow and Frank McCourt reached an agreement Wednesday that averts the possibility that the San Francisco Giants fan beaten outside Dodger Stadium three years ago might have had to pay up to $400,000 in trial costs to the former Dodgers owner. After a session in chambers with Los Angeles Superior Court Judge Victor Chavez, the lawyers emerged and said Stow is dropping his request for a short trial on one unresolved legal issue in exchange for McCourt agreeing not to seek recovery of his expenses.“This was a lot of nothing,” Stow’s attorney, Thomas Girardi, said outside court. On July 9, a jury awarded roughly $18 million in damages to Stow, who was beaten into a coma outside Dodger Stadium on March 31, 2011. But after a lengthy deliberation, the panel found that only Los Angeles Dodgers LLC, the business entity created by McCourt when he owned the team, and Stow’s two assailants were liable.last_img read more

Birds Sing Duets

first_imgThe little wrens in your backyard are not only soloists; they sing duets.  A number of birds have been found to sing together in unison, or in antiphonal pairs.  Some alternate melodic lines in rapid-fire succession and some sing in choirs.  This was described by Susan Milius in Science News.1  One ornithologist was stunned in the mists of Ecuador when he heard a group of wrens singing together, in “one of the most complex singing performances yet described in a nonhuman animal.”  Duetting is known in at least 222 species of birds.    One researcher found a four-part, synchronized chorus with alternating parts of males and females who shifted parts at least twice a second. And when one considers the split-second alternation, the birds’ singing surpasses human vocal virtuosity.    That’s the latest, most extreme example of duetting birds, a phenomenon that has fascinated birders for decades and inspired its own chorus of theorizing about what might drive such displays.  Warning off rivals?  Foiling flirtations?  Checking musical passwords?  In the past few years, field biologists have applied modern ideas about evolution to begin new tests of why duetters do it….Over several decades, scientists have offered at least a dozen explanations for the purpose of avian duets.  The theories have focused on the forest, the pair, or conflicts of interest between individual birds.   (Emphasis added in all quotes.)Milius listed a number of proposals, but each seems to have exceptions, and none rises to the top.  “All the ideas about the function of duets need more testing,” is the conclusion.  “As bird duets start to make sense, maybe they’ll shed light on other duetting species.  Birds duet.  Bugs duet.  Even some primates do it.” (That’s us.)    The online article has links to websites where you can listen to sound files of the birds singing.  Here’s one by Mennill and Rogers and another from Daniel Mennill in Costa Rica.1Susan Milius, “Just Duet: Biologists puzzle over bird’s ensemble vocalizations,” Science News, Week of Jan. 28, 2006; Vol. 169, No. 4 , p. 58.It seems overkill for evolution to produce the complex brains and sensory capabilities required for high-speed coordinated singing of melodic lines just to protect territory or attract mates.  There are things in nature too wonderful for mere survival.(Visited 12 times, 1 visits today)FacebookTwitterPinterestSave分享0last_img read more

ExMan Utd coach Lingard is the English version of Iniesta

first_imgRene Meulensteen has hailed Jesse Lingard as England’s answer to Barcelona and Spain icon Andres Iniesta. The Dutch coach worked for the Manchester United first-team during the final six-and-a-half years of Sir Alex Ferguson’s trophy-laden career and helped bring Lingard through the youth ranks at Old Trafford.Across recent weeks, the 26-year-old has impressed greatly under interim coach Ole Gunnar Solskjaer with the Norwegian praising him for “fantastic” development earlier this week.Lingard has managed three goals and two assists in seven starts since his former academy boss replaced Jose Mourinho in December. And now Meulensteen is the latest to praise Lingard, who he believes not only has all the qualities that Ferguson valued most in a player but shares many similarities with Spanish midfield maestro Iniesta.“Sir Alex always had a clear picture of what a good player looked like and they had to have quick feet, quick brain, and a big heart,”  Meulensteen told 888sport.“That is basically everything that Jesse had but he was very slight for his age. I worked with him from the age of eight or nine, taking him abroad for tournaments. He was always having to fight battles because he was tiny in build.Harry Maguire, Manchester UnitedLiverpool legend Nicol slams Harry Maguire’s Man United form Andrew Smyth – September 14, 2019 Steve Nicol believes Harry Maguire has made some “horrendous mistakes” recently, and has failed to find his best form since joining Manchester United.“But all things level themselves out and eventually those three things make a difference – quick feet, a quick brain, and a big heart. And he has done ever so well.“The fans always need to associate themselves with players who have come through the ranks.“While I was there and Sir Alex was there, it was so important to keep bringing young players through.“The difference with Jesse is that he was always the English version of Iniesta. He can play in the pockets, he’s very mobile and very agile.“He can beat a man and he’s good in combination play. The last few seasons he started to score important goals as well.”Lingard will hope to continue his solid run of form in United’s trip to the King Power Stadium on Sunday in a Premier League match against Leicester City.last_img read more
