in Sugar Land Texas on Oct 30 2006 Brooks Kraft—Corbis 1 of 12 Advertisement As first reported in my book The First Family Detail the agents who were diverted to protect Chopey also retrieved confidential law enforcement records on Chopeys neighbor who had allegedly harassed her But neither the Secret Service nor the FBI has the authority to protect its own employees Only when a federal law enforcement officer is threatened or retaliated against as a result of an investigation does such action become a federal offense As a support employee Chopey is not a law enforcement officer and was not engaged in an investigation Thus retrieving 13 pages of records on the neighbor violated federal criminal laws because the agents had no legitimate law enforcement authority to conduct an investigation of this nature (a point the DHS report failed to note) Also left unsaid in the DHS report was that one of the purposes of the Prowler team is to look for possible snipers as Marine One lifts off with the president from the White House grounds On July 1 2011 Obama and his family left in the helicopter in the late afternoon to go to Camp David but the Prowler team was nowhere to be found Instead the team had been diverted to protect Chopey in southern Maryland As if that is not shocking enough the DHS report quotes Secret Service management and former director Sullivan as defending the decision to divert agents from protecting the president They claimed the diversion did not impinge on the presidents safety That along with the comment by former Secret Service Director Julia Pierson that Secret Service uniformed officers exercised "tremendous restraint" in not taking out Gonzalez even though he penetrated the White House pinpoints both the arrogance and the negligence of the Secret Service today The Secret Service agents involved in Operation Moonlight were fully aware that they were breaking the law but they felt that their jobs were on the line a Secret Service agent who asked not to be quoted by name for fear of reprisals told me for the book The agents "obtained all this information illegally and kept it and were told not to talk about it outside the squad" the agent says "They kept records at the duty desk and made agents on every shift initial that they had gone all the way out to southern Maryland to check on the womans welfare on the taxpayer dollar" DHS Secretary Jeh Johnson has appointed a four-person panel to recommend security improvements at the White House and to suggest a new director One development the panel should explore are so-called non-lethal weapons such as ear-splitting sound and high-energy beams that are used to protect our nuclear facilities And the panel should recommend an outside director such as a former FBI official to change the management culture that encourages cover-ups and brazenly defends the indefensible This time the Secret Service succeeded in apprehending a fence jumper The next time it may not It took the assassination of President Kennedy to substantially upgrade the Secret Service the last time It should not take another tragedy to reform the Secret Service now Ronald Kessler a reflect the views of TIME editorsWhen Stephen Colbert was announced as the second-ever host of CBS’s The Late Show (succeeding David Letterman for whom the program was created) fans and observers wondered just how the transition would go Colbert after all was famous for playing a character a blowhard politico on Comedy Central’s Colbert Report Tuesday night’s premiere of The Late Show under Colbert didn’t put those questions to rest exactly; after all Colbert’s had a little over one hour on-air as himself after some nine years as “Stephen Colbert” His precise persona remains hazier than the precise place he’ll occupy in the late-night firmament In contrast to the naif-like Jimmy Fallon and the prank-loving Jimmy Kimmel Colbert is to be the network host who thinks the hardest about what it means to be a network host The first episode of the show reflected more than anything a productive sort of anxiety over bridging Colbert’s intelligence with the imperatives of network TV Colbert brought a Grand Guignol commitment to his moaning over the favors he owed a spirit inhabiting a dark amulet in his studio; the principal favor was to promote a brand of snack food that had presumably paid CBS for the privilege He carried across a fairly sharp metaphor over how over-coverage of Donald Trump in the media is like glutting oneself on Oreos but in so doing broadcast several clips of Trump from August that were themselves a bit past their sell-by date Colbert has earnestly committed to being both a good host and one that fits into our media climate but the first episode’s humor came from how he fit his persona into that framework rather than how he redefined it A first episode is too early to tell what exactly the show will become: Jimmy Kimmel’s current claim to fametaped pranks and acid-tipped celebrity stuntscame to the fore once his ABC show was well underway But Jimmy Fallon’s debut on NBC’s Tonight Show reliant as it was on totally good-humored toothless star cameos set the tone and it’s not hard to imagine that Colbert’s first episode will do the same The show’s high points came in Colbert’s interactions with his celebrity guests Colbert made a big show of presenting first guest George Clooney with a wedding gift: A Tiffany paperweighttypical hostly chumminessengraved with the phrase “I don’t know you” And to Jeb Bush he spoke frankly telling the presidential candidate “There is a non-zero chance that I would vote for you” and using personal anecdotes to invite the Florida politician to speak more about how he specifically differs from George W Bush (The answer for what it’s worth The 43rd president’s Republican Congress that spent money too profligately) None of this was weird or subversive but for the fact that it took place in a context where late night is best at producing next-day clips not commentary on the celebrity-industrial complex or political insights Colbert was dutiful in many senses: He featured (in brief cameos) his former boss Jon Stewart and main competition Fallon gave a deeply earnest tribute to his predecessor Letterman and paid tribute both to CBS’s sponsors and to his family He’s clearly ready to go broader: Colbert used his opening minutes to make late-night talk-show-host-y jokes like flat references to Ashley Madison the History Channel and Willie Nelson’s widely-remarked-upon love of marijuana that would have been more than a bit too broad for cable His renovating the ceiling of the Ed Sullivan Theater to resemble a cathedral’s dome seems to have symbolic meaning: This is something akin to church for Colbert (a devout Catholic) He’s born to be and has worked yet harder to be a great traditional talk-show host at a time when the value of such a host has never been less clear Indeed the way he’ll fit into the talk-show ecosystem as it exists in 2015 remains to be seen Colbert’s two terrific interviews felt both too substantial and too meta to really thrive on a YouTube ecosystem that has recently rewarded hosts who’ve enlisted celebrities for either party tricks or just plain tricks The show will find its groove very soon but it may take a bit longer to figure out exactly what role Colbert will play: Affable throwback act or world conqueror His fans though have reason to hope There’s room for real subversion in the late-night talk show that hews to the traditional and not just in new ways to get sponsor messages in Colbert in his show’s first moments mentioned his pride in his mother: A pennant she got for attending Martin Luther King Jr’s 1963 “I Have a Dream” speech adorns the studio "Sadly civil rights only won the pennant that year” Colbert said “Racism won the World Series” It’s a sharper franker and better-developed joke than anyone other than a Colbert fan might have expected from network late night And best of all it was delivered by Colbert as himself Read about changes to Timecom Contact us at [email protected] Wednesday enforcement action comes in the wake of substantiated neglect leading to a client’s death a sexual assault of a resident by a staff member and a series of compliance violations spanning nearly two yearsIn an agreement with the Minnesota Department of Health Minnesota Heritage House must transfer the management of its facilities in Pequot Lakes Adrian and Kimball to another home care provider By Dec 1 Serenity Living Solutions of Sebeka will assume all administration and management of client careScott Smith public information officer with the Health Department said the arrangement would mean minimal disruption for clients living in the facilities while responding to "serious incidents involving harm to clients and a persistent pattern of ongoing correction orders""MDH tried to manage the situation as to not create a crisis for the residents at these locations and at other housing with services sites owned by ElderCare of Minnesota" Smith stated in an email "By allowing Heritage House to voluntarily relinquish their license residents can continue to live at the facility and transition to a new provider with minimal disruption Heritage House is also cooperating with MDH to bring in a new provider of services and manage the transition"Heritage House is not permitted to admit any new residents under its license although Serenity Living Solutions may do so prior to the complete transition While Minnesota Heritage House will continue to own the buildings MDH required that current owners administrators or managers of the license must remain at "arm’s length" and cannot provide or administer care They also may not seek any new applications for home care licenses for five yearsA worrisome recordThe agreement signed last month lists a series of licensing violations identified by MDH between November 2015 and June 2017 The timeline shows while many of the violations were corrected upon reinspection many were not and new violations continued to show up at the facilities The MDH issued the facility a warning in March due to compliance issues and in May it was noted ongoing complaint investigations brought renewed concern over the "health and safety of Heritage’s residents"Among those investigations was one finding Heritage House responsible for neglect in the February death of 86-year-old Ralph Ford The investigation showed neglect through improper catheter care and an unclean environment led to Ford’s death by a complex urinary tract infection This included a failure to flush and change the client’s catheter and a failure to maintain infection control on the catheter equipment In 2016 a complaint investigation found an employee responsible for the sexual abuse of a resident David Erwin DeLong of Pine River was also criminally charged and pleaded guilty to fourth-degree criminal sexual conduct the sentencing for which is scheduled next month According to the criminal complaint filed against DeLong he sexually assaulted a 78-year-old woman in May 2016 The woman was nonverbal wheelchair-bound and unable to feed herself requiring around-the-clock care the complaint statedAlthough referenced in the agreement details are not yet available for a third complaint investigation conducted in July which resulted in two Level 3 violations—those that harmed a client’s health or safety not including serious injury impairment or deathOwners cite turnover facility growthOwners James and Kathy Birchem said Monday Oct 30 they’ve been cooperating with the MDH and working to address concerns at the Heritage House facilities for several months This includes hiring Zellner Senior Health Consulting to assist in achieving compliance"This has been a very long process" Kathy Birchem said "This has been the best solution that we could come up with for our residents at this point in time so they could remain in their current home"She said none of the people employed at Heritage House facilities would lose their jobs because of the transferThe Birchems Little Falls natives purchased their first nursing home in Bemidji in 1996 according to their company ElderCare of Minnesota’s website They own 15 senior living facilities throughout the state—mostly in central and north-central Minnesota but also four facilities near the Minnesota-Iowa borderSmith reported the company operates under six different licenses through MDH although only the one held for the Heritage House facilities in Pequot Lakes Adrian and Kimball is affected"We are allowing ElderCare to continue to offer licensed home care services at other locations to avoid disruption of services for those residents and because those facilities did not have the same quality and noncompliance issues" Smith statedKathy Birchem said although the license applies to three locations the Adrian facility was not responsible for any of the correction orders required by MDH"To correct the deficiencies that we were given they needed to be corrected at all sites" Kathy Birchem said "Because they’re located in different towns some of the corrections weren’t done that should have been done"When asked why they believed the Heritage House facilities continued to be troubled the Birchems cited staff turnover and facility growth"The systems weren’t followed as closely as they should have been" Kathy Birchem saidAs owners the Birchems receive weekly reports on their facilities and have quarterly meetings with site managers Kathy Birchem said Each facility has a lead nurse and an operations managerIn the investigation of Ford’s death nurses interviewed said a sudden and recent departure by a nursing director made it "confusing for the remaining two RNs (registered nurses) to figure out when things were due"Kathy Birchem said she wanted the families of those living in Heritage House to know they have confidence in Serenity Living Solutions"We’d like them to believe that their loved ones are in caring hands" Kathy Birchem said ".
